Q.1. Translate the following text into Arabic (20 pts)

 

KUWAIT: National Assembly Speaker Jassem Mohammad Al-Kharafi yesterday strongly condemned Israeli aggression on the Gaza Strip. In a statement to KUNA, Al-Kharafi said that this aggression represented genocide against unarmed and besieged[1] people, which was a "loud" violation of international laws and UN resolutions and a breaching of all human values, especially as the attacks came during religious occasions of both Muslims and Christians.

World powers called for an immediate end to violence. UN Secretary General Ban Ki-moon, the European Union and Russia urged both sides to stop the violence, as Israel's strongest ally the United States said the Jewish state should avoid civilian casualties. More than 200 Palestinians have been killed, according to the head of Gaza emergency services.

In the Middle East, the Arab League singled out Israel for blame, and the Organization of the Islamic Conference accused it of a "war crime" for not protecting the lives of civilians. Middle East envoy Tony Blair deplored the "tragic of loss of life", and called for an end to rocket attacks from Gaza and Israel's air strikes. The French EU presidency expressed "greatest concern at the escalation of violence in the Gaza Strip ". The EU also called for all crossing points out of Gaza to be reopened and deliveries of aid and fuel to be resumed, as well as free access for international humanitarian groups, journalists and diplomats, which Israel has blocked.

Russia's foreign ministry called on Israel "to halt immediately the large-scale acts of force against the Gaza Strip" and said that the most important priority was for the parties to restore a truce. "The United States urges Israel to avoid civilian casualties as it targets Hamas in Gaza and Hamas must end its terrorist activities if it wishes to play a role in the future of the Palestinian people."

A similar message came from German Foreign Minister Frank-Walter Steinmeier who told Hamas to "immediately and definitively end its unacceptable rocket attacks against Israel". He urged the Jewish state "to do everything to avoid civilian casualties,"

In the region, Amr Mussa, secretary general of the Cairo-based Arab League, called for an emergency meeting on Sunday of foreign ministers of Arab countries. He asked Libya, currently a member of the UN Security Council, to organise an emergency meeting about the Israeli raids.

Q.1. Translate the following text into English (20 pts)

 

أصدرت محكمة سعودية السبت 20-12-2008 حكما برفض فسخ نكاح طفلة ذات 8 أعوام قام والدها بتزويجها غيابيا من رجل خمسيني، وقرر قاضي محكمة عنيزة خلال الجلسة المقررة للنطق بالحكم اليوم انتظار بلوغ الطفلة الحيض، واكتمال التكوين الأنثوي للتقدم بطلب طلاق.

وتعود تفاصيل القضية التي بدأت منذ نحو ثلاثة أشهر عندما علمت والدة الطفلة مصادفة قيام زوجها بتزويج ابنتها ذات السنوات الثماني لرجل في العقد الخامس من العمر دون علم الطفلة، وذلك كجزء من قضاء دين على والدها مقابل مهر يقدر بـ30 ألف ريال يخصم من قيمة المبلغ المستحق على والد الطفلة.

وبادرت الأم برفع قضية فسخ نكاح لدى محكمة عنيزة ؛ إلا أن القاضي منح العائلة 100 يوم لمحاولة إيجاد حلول بديلة للصلح باءت جميعا بالفشل إثر رفض الزوج تطليق الفتاة.

من جهته قال خال الطفلة أحمد السلامة في حديث لـ"العربية.نت": إن الفتاة لا تعي شيئا، وإنها ما زالت تعيش مع والدتها في عنيزة ، "هي لم ترَ هذا الزوج ولم يرها، وقد تم تزويجها في غيابها، وعدم معرفة عائلتها وحتى أخوالها".

وأكد السلامة أن المحامي بعد صدور الحكم عرض على الزوج إعادة مبلغ الـ(30) ألف ريال "المهر" له مقابل تطليقها؛ إلا أنه رفض قائلا: "ومن يعطيني حقي أراكم بعد 10 أعوام".

وأبدى انزعاجه من الحكم، مؤكدا -في ذات السياق- على تصميم الأسرة استئناف الحكم عن طريق تقديم لائحة اعتراضية لهيئة التمييز في الرياض: "هذه مأساة حقيقة لا أعلم ما نهايتها، فالوالد رجل مشتت لا يعلم عن أبنائه شيئا".

واستند محامي الدفاع في قضيته على إخلال مأذون الأنكحة الذي عقد قران الطفلة بمادتين من اللوائح التنفيذية لمأذوني عقود الأنكحة؛ حيث يتعلق الأول بتحرير عقد النكاح في مدينة بريدة بمنطقة القصيم، فيما تسكن الزوجة محافظة عنيزة ، إضافة إلى عدم تأكد مأذون الأنكحة من رضا المخطوبة على النكاح، وذلك بعدم سؤالها حتى وإن كان والد الطفلة وليا لها.
